Welcome to Digital Dugout. These Terms & Conditions govern your access to our marketing services and domain. By engaging our agency or requesting a growth audit, you agree to these terms in full.

1. Company Identity & Registration

These terms are governed by Digital Dugout. Our physical locations are detailed below:

2. Scope of Service

We provide digital campaign planning, Google Search SEO management, Facebook & Instagram Ads, local business directory alignment, and custom landing page development. Strategy recommendations are based on historical search volumes and competitor analyses.

3. Billing & Spends

Ad campaigns on Google and Meta require direct ad budget payment, managed via client-owned payment cards. Agency fees cover campaign design, ongoing bid adjustments, conversion analytics setup, and performance reports.

4. Refund Policy

Agency fees pay for work performed — strategy, campaign build, management time, and reporting — rather than for a guaranteed ranking, lead volume, or return. Because that work is delivered continuously, fees are handled as follows:

• Work already delivered: Fees covering a period in which work has been carried out are non-refundable.
• Work not yet started: Where a service has been paid for but not commenced, the fee is refundable in full.
• Part-completed engagements: Where an engagement ends mid-cycle, we refund the unused portion on a pro-rata basis, calculated from the date written notice is received.
• Advertising spend: Budgets paid directly to Google or Meta sit with those platforms and are governed by their own terms. We cannot refund money we never held.
• Third-party costs: Domains, hosting, licences, and paid tools bought on your behalf are non-refundable once purchased.

Approved refunds are issued to the original payment method within 14 business days.

5. Cancellation Policy

Either party may end an engagement by giving 14 days' written notice to the other, sent to the email address in section 9.

• Work in progress continues through the notice period, and fees for that period remain payable.
• Campaigns already scheduled or committed for the notice period will run unless you ask in writing for them to be paused.
• On the final day of the notice period we hand over account access, creative assets, and reporting for work that has been paid for in full, as described in section 6.
• One-off projects, such as a website build, may be cancelled before work begins for a full refund. Once work has started, section 4 applies.

6. Data Ownership & Intellectual Property

Upon complete settlement of agency fees, the client retains full ownership of all customized copy, graphics, web code, tracking pixels, and Looker dashboard setups generated during active cycles.

7. Limitation of Liability

We deliver our services with reasonable skill and care, but digital marketing results depend on factors outside our control — search engine and platform algorithm changes, advertising policy decisions, competitor activity, and market conditions among them. Accordingly:

• We do not guarantee any specific ranking, traffic level, lead volume, conversion rate, or return on advertising spend.
• We are not liable for indirect, incidental, or consequential loss, including loss of profit, revenue, goodwill, data, or anticipated savings.
• We are not liable for the acts, outages, policy decisions, or account suspensions of third-party platforms, including Google, Meta, hosting providers, and payment processors.
• Where we are found liable, our total aggregate liability is limited to the agency fees you paid us for the three months preceding the event giving rise to the claim, excluding advertising spend and third-party costs.

Nothing in these terms excludes or limits liability where it cannot lawfully be excluded or limited, including liability for fraud.

8. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the county courts located in Coimbatore, Tamil Nadu, India.
